New kid's last name

I am in the middle of a divorce, and am changing my name back to my maiden name after it's done.  My first kid has my ex-husband's last name.  Do I change her name and give my boy my last name, leave her name the same and give him my last name, or keep them both with his last name?  I'm struggling with this.  It doesn't help that the father is barely around, but keeps talking about how he wants to stay around and be here for the kids.  Any advice?  Anybody been in this situation?  Any help is appreciated.  TIA!!

  • You would have to check with your lawyer but you usually can't just change a child's last name without the other parents permission. Would he agree to changing your daughter's last name?

    If he isn't really involved and doesn't plan on being involved I would ask to change your daughter's last name and then give your sons yours.

    If he won't agree to the change to your last name maybe you could hyphenate.

  • DS has STBXH's last name. I told my husband that when we divorce, I am keeping my married name because I want my son and I to have the same last name. It is just easier for me to keep the name than to try to change everything.
