Can this happen?

I got 2 texts from Ex. 1st one asked if I'd bring Wy down for a visit (haha.. Nope) and the 2nd sent seconds later says "mediation is a waste with you, I want to go straight to court" can he request that? Seems ridiculous to me. I haven't responded to the texts.

  • Where I'm from, no, you can't go "straight to court". Mediation is a form of "going to court" anyway...I'm sure he meant trial though. In my area, the courts will make you go to mediation before your case is brought to trial.

  • Is he a lawyer?  Does he play one on TV?  Don't listen to the ramblings of a person who doesn't know the law or the court system any better you.  He's making treats to scare you and you're listening. 

    THE ONLY PERSON YOU NEED TO LISTEN TO ABOUT THE COURT/LAW RELATED MATTERS IS YOUR LAWYER AND THE JUDGE.  EVERYONE ELSE IS TALKING OUT THEIR A$$!

  • In situations like these, especially for the sake of controlling your life and your child's life, I would be prepared for the worst case scenario so you don't get taken advantage of.  It is likely he is fluffing or does not know what he is talking about but at the same time, he has just same options as you do when it comes to getting your own lawyer and etc

  • Ignore, ignore, ignore!  Remember, he's not a judge or an attorney.  Consider whatever he says to be a lie, unless a judge or your attorney confirm.  And also, just an FYI, I'm sure that 110% of the things he tells you in anger are lies.

  • Thanks ladies. I figured that decision wasn't up to him I just wanted to check. I have a meeting with my lawyer this week about mediation.
