Should I file for Custody?

I haven't talked to my daughter's father since before she was born.  I doubt he will ever contact us, but I feel like maybe I should file for custody JUST IN CASE.  I'm worried because right now I'm not working and financially I'm not in a good place.  However, I have stable living arrangements and support from my family and friends.  She wants for nothing and is well taken care of...

I just don't know what I should do...HELP!

    You do not need to file for custody then. If he wanted visitation he would have to submit to a DNA test to prove paternity.

    This... And I doubt he will want to pay you child support or the $$$ to be legitimized. It's expensive. We went through it with my sweetest baby angel of a step daughter and we are going to court for the second time with her mom bc she is not giving us our visitation as stated in our custody agreement signed by the judge (bc I am prego) and I would spend the load of $$$ all over again just to see her. You really have the upper hand in the situation.

  • I am in the same situation.  Lil D's father has never seen him nor does he ever make any attempts.  I asked my lawyer when we were doing through the support hearings if I should file for custody right away.  She told me not too.  If he wants to see DS then let him pay for all of it.  His name is not on the BC and  DNA test confirmed he was the father.....which I knew with out a doubt he was.
