NCDR: Ayudame! What can I do?

Ok,

 

I live at an awful apartment complex; and if not for our lease we would have been gone months ago. There are maintenance issues that haven?t been fixed since day 1. (Mold in bedrooms, outlets that don?t work/ rotted flooring in bathroom) My husband and I are moving at the end of this month. Our lease at our current apartment is up September 10th. Yesterday, my husband dropped off the notice at their office. They called back and said that they needed a 60 day notice and that we had to stay another month. (Even though our lease ends in 30 days)

 

That would normally be alright; except for the fact that I am quitting my job and may not have another month?s rent. (For two places, anyways) I plan on going into the office today to see if we can work something out, but am not hopeful that they will oblige.

 

I know that I should have checked to see if it was a 60 day notice or a 30 day notice. Totally my fault on that, but I just spaced. So my question is, is there anything I can do since there were so many maintenance issues that were never fixed? I mean, a contract is two sided- and they definitely didn?t keep up their side of the deal. The only thing I can think of is filing a complaint with the BBB. But even then, I don?t know what that would accomplish.

 

Any thoughts/ideas on how I can get them to be alright with a 30 day notice? Or are we just stuck for another month? I am just so completely fed up with this place; words cannot express how much I?m ready to move.

  • First, read over your rental agreement very carefully.  Pay close attention to what it says about giving notice as well as your landlords obligation to fix problems.  Second, find out if there are renters rights laws in your town, some communities require that landlords provide housing that meets safety standards and mold may fall under this. 

    If they've stayed within the letter of the law maybe you can come to an agreement that they will let you out of your 60 day obligation if they find new renters to fill your spot by Sept 10.
