Visitation Question

I'm pretty sure I know the answer to this but I just wanted to get some other opinions.

 Is it required that I switch visitation days with my son's father? 

He asked to switch and I can't due to prior plans. He has known it was his visitation day for months so he has had plenty of time to make plans around the visitation schedule.

When I said no I couldn't switch he told me I had to. I am more than happy to keep my son with me but I don't think I should have to change plans that I already have with my son because of him.

He said his lawyer is involved now but I will wait until my lawyer contacts me and I will just keep to the set schedule.

  • No you are not required to switch.  The only thing you are required to do is to follow the court ordered schedule. 

    Only you know who you are dealing with, but it seems to me based on what you wrote, he doesn't seem to think any rules apply to him and you should be the one to bend to his will and his convenience.  

    Oh, and the whole I'm going to get the lawyers involved b/c you won't do what I want you to do, is a manipulation tactic and he's swatting at flies w/ bombs.  It's his parenting time, if he is unavailable then he needs to make child care arrangements at his expense, just like other parents who need to be somewhere without the children.

  • Like Sweetie said, no, you are not required to switch with him. The only thing you're required to do is let your X have your LO on the days stated in the court order. If he cannot watch your LO during his time, he can either leave LO with you or find alternative child care. You don't owe him anything as far as making up time for missing his parenting time.

    While it's ideal if you can compromise and switch times, I understand you can't because of prior plans. It's just a shame he doesn't see that.
