Question that someone may be able to answer...

Just got an e-mail from my attorney that he, my STBXH and his attorney and me may have a 4 way meeting.  But, STBXH is not amenable to meeting unless overnights will be a possibility.  My attorney put in parenthesis that a court would grant him this anyway.  Is that true?  We live in NJ and my LO is 1 year and still breastfeeding.  Anyone go through the same thing?  Did you have more luck holding your ground and taking your chances in mediation or court?

  • Although I don't know much about the whole visitation thing in the US but I can tell you from reading previous posts that bf'ing may not have an impact on it. If your LO is in daycare and you pump for that, there is usually no reason that you couldn't pump for him to go on an overnight trip.

    Again, I know nothing about your situation but that is what i've gathered about bf/visitation.

  • It's true that if you are able to pump and the father has been active in his life the last year, breast feeding won't keep him from getting over nights. Unless there is some reason why STBXH shouldn't have LO over night, you would be wasting your time by taking chances. By meeting you look like you are trying to make this work and it will look good on your part.
  • What does your lawyer say?  He/She is the expert in your state with the judges in your jurisdiction.  
  • I WANT to meet and work out a arrangement that would be appropriate for our son.  The kink in the plans is that my STBXH is very "you do what I say and I won't agree to anything but what I want" kind of guy.  He is EXTREMELY stubborn...so much so that he refuses to communicate with me about LO at all...he just won't answer me and ignores me completely.  I would rather something that would deescalate (spelling?) the situation because I think that regardless of what a DB he has been to me my DS should have a relationship with his father.  I just want measures in place to ensure his safety as STBXH has had documented anger issues in the past (what we went to counseling for, for about 10 months).

  • in nj, under 12 months is considered "tender years" where they dont have overnights.
