Ex new job and CS question

My EX has been interviewing for this new job where he has the ability to make 80k a year. 60+ commission. Let's say he gets it, can I take him back to court for more child support? In his custody papers he asked for it to be reduced but if he's making twice what he makes now it should stay the same or increase, right?. We are mediating soon and I want to bring it up then. My lawyer said if he gets it it'll make a great case for requesting the back support he owes me.. Thanks!

  • My understanding is that yes-that is a change in circumstances and you can have the calculation revisited.  I think it varies by state how the amount is calculated.  Some states take LO's expenses into consideration, others simply pro-rate the parents' income in the determination.

  • Legally, he's supposed to be reporting any change in employment/income, but we all know they don't do that.

    In my state, we can have 1 CS review every three years. I imagine your state has some kind of limit as well.
