questionn..

well im usually just a lurker, but i have a question.
so im sure this has been asked at some point so sorry for asking it again..

heres a little background so your not confused..

the 'sperm donor' and i were never married and when i got pregnant he left and i havent talked to him since i was like 5 months pregnant and he moved to another city like 3 hours away..

so my question is.. do me and him have the same rights .. ive talked to a couple poeple about it and one lady said that we do and another said that we dont.

im in the process of establishing paternity (but he was a no show.. big surprise).

im also in the process of getting full custody just to be safe.. but the one lady i talked to said i shouldnt have to get full custody bc i already have it. so im so confused.. do i or what?
either way im going to get full custody so its on paper leagally.

  • If he's not on the birth certificate, then legally he can't take off with your child if he does decide to come around. HOWEVER you definitely should have everything on paper regarding custody, visitation, child support etc.

  • He doesn't have any rights until he files for custody/visitation himself. Since you were unmarried, he doesn't automatically get anything when it comes to your LO.

    Good for you for filing through the courts thought -- better to be safe than sorry.

  • You have full custody at this time.  You do not need to file anything.  Once he is declared the father he may want more rights and file in court.  But until than, I would leave things the way they are.  You have the rights at this point.  I was informed by one attorney, not to file as I will only be providing him with the legal rights, and to just wait until I get served then go from there.

  • As PP stated he has no rights until/unless he files for visitation.  However, you should be sure to file for child support, whether or not he decides to be involved in your child's life or not.  Child support has no impact on visitation so be sure to make sure your child is properly provided for.
