FMLA question

Does anyone know if you are required to use your PTO as part of the 12 FMLA weeks, or say if you have 2 weeks of PTO, do you get that plus 12 weeks of unpaid leave?  Or is it specific to the company?  TIA!

  • I believe it's company specific. I get 1/4 of my PTO taken away for being on leave for 1/4 of the year.  I can then use the rest to either get paid during the unpaid portion of my leave or keep it and use it at any other time during the year.

    This.  The only thing fmla does is assure you they can't fire you during those three months.  Some companies will hold your job longer, but they can't take it sooner than that.

    Yep. Also, some companies let you use your banked sick leave for your FMLA time, while others (like mine) make you use your vacation time. And by make, I mean make - if you want to take any kind of leave, you have to use any time you've got, you cannot choose to go unpaid.

    Yeah, no.  I got let go during my FMLA leave.  The company I was working for "didn't have the hours" and were downsizing my particular position "company-wide, not just at [my] store".

    So yeah, they can't fire you, but should your company happen to do a little down-sizing, or decide to make your position redundant while you're gone, you're boned.

    OP - paid vs unpaid and all that varies by company.

    Secondly, I should have been more specific.  They can't fire you solely on the basis that you're out on your maternity leave.  There are ways around it, but they can't say "well, you had a baby so we're firing you".  Btw, that sucks your company was a bastard.

    And yeah, they can fire you because you had a baby, as long as they call it something else and you can't prove it was because of the baby.  Damn loopholes.

    More elaboration... they chose who got to keep their jobs based on seniority.  The girl who kept hers over me started working for the company less than 2 weeks before me, some 3 years ago.  Seriously?  Also, she was a raging biotch and no one in the pharmacy liked her (but the actual store manager is her BFF).  Now they're stuck with her. Suckers.
