Insurance Question?

So my husband has filed for divorce. I don't work (too incredibly sick even at 18 weeks!) I'm wondering what happens with his insurance? I have no clue if my baby and I have any options. I am moving back in with my parents ... Just was wondering what happens to insurance when a spouse divorces half way through a pregnancy?

  • It can be put in the decree that he has to keep you on the insurance till LO is born and then has to keep LO insured after that.

    If he won't or the judge won't order it, you can get on Medicaid.

  • My job was pretty sneaky about insurance, and would only allow you to enroll for benefits twice a year, but would never tell anyone when that was, even if you asked. It was BS, and of course I got pregnant about a month before the open enrollment, and they decided that pregnancy was a "pre-existing condition" and so would not cover me.

    Medicaid was a life saver. I wouldn't have been able to get health care otherwise. I'm not sure about your state's procedures, but in FL your eligibility is assumed if you're pregnant w/o insurance. 

    I've got no clue how it will work with your divorce, because I wasn't married when I had DS, but if all else fails, know that you have Medicaid to fall back on so you don't have to go without health care.

    Yeah, his insurance only has one inrollment date and if you miss it too bad. Luckily he has been there a while so we eventually go in. I live in Fl as well, Gainesville, until I move this next week back home to Sarasota. Hoping that maybe I can make sure I can stay on his insurance until baby is born, but if not I think I might have to file/apply for medicaid after the divorce is final. But as long as my LO is covered that is the most important thing to me! Thank you for your advice :-)

  • You might consider getting a temporary order that he maintains insurance on you and your unborn child.  The state of Florida (and most other states) ask specifically if the wife is pregnant when you fill the paperwork out.  

    Talk to a lawyer or legal aid asap.  Also remember that the county this legal proceedings are filed in will be the county will have jurisdiction regardless of where you or the child reside.

  • I work for a health insurance company...a good one thank goodness.  First of all most insurance companies will let a subscriber drop any dependent whenever they like.  So I would get a court order that states he has to cover you until the divorce is final.  I think this is pretty common in most states as far as the people I talk to every day.  Also keep in mind that if you are moving out of area make sure you check with the insurance company to see what providers are covered in the new area.
