Our papers state that child support payments must begin on June 1st. Does that mean that Ex has to have a check to the FL office by June 1st, and then they send it to me here, or that I am supposed to have the check by then? I am not sure how that works. I DOUBT he will even send a check, so how long do I wait until I call my CS rep? I wish they would just deduct it out of his paycheck...
Re: CS payment
I don't receive CS, but I do have to pay spousal maintenance until November and the order was written that spousal maintenance would take effect April 1st. The spousal maintenance is garnished from my paycheck, so my XH didn't get his first spousal maintenance payment until my first April paycheck (mid-month). The maintenance is equally spread out over my paychecks each month (half is taken out in my mid-month paycheck and the other half is taken out in my end-month paycheck). XH will receive these payments through my last paycheck of November.
Long story short, it's not necessarily based on when the order becomes effective, but when my paychecks are issued. It may vary state to state, but I know that CS is paid the same way as spousal maintenance here.
Here in PA my son's father has until the end of the month to get the money to CS. He has it deducted from his paycheck and his employeer still has until the end of the month to send it in even though its taken out of each check.
I haven't received any money for May yet, even though he was paid on 5/13, but I have to wait until 6/3 to contact CS because they have 2 days to send it to me after the last day of the the previous month.
If he was paying it himself he would have to be 2 months behind before they would start to garnish his paycheck but he voluntarily had them do the garnishment.
I hope you get it!
