Asking X if he/she has made more money

 since the time the original custody papers were drawn up?

Just curious if anyone has ever done it.. and if you have a right to ask especially if they have changed jobs since time of original custody papers were drawn.

  • I think I'm allowed to amend my child support every 3 years in SC.

  • I'm in PA, I'm allowed to have CS modified every week if I want but if I don't request a modification then the state reviews it every 4 years. 

     

    Don't ask HIM if he's income has change just file w/ the court/domestic relations and have them review it.  They can subpoena his employment records and his income tax filing.

  • I was wondering this too. Ex has another job that he didn't tell our caseworker about but he gets paid under the table so there isn't much I can do about it but the $149 a month I get doesn't really help much.

  • If you know where he's working under the table, you can still report that business to the enforcement officer, they can still subpoena the records and guess what the business really dislikes the government snooping around their records and ex gets let go.  (which doesn't affect you b/c that money wasn't going to you or your LO) but he learns the hard way that working under the table doesn't "Get around the system"

    You could also (at the same time) report it to the IRS which may get you a finders fee for turning in Tax evaders. He will then learn another hard lesson that "getting around the system" doesn't work.

    I have done the first suggestion, my ex did get fired. AND my enforcement officer started to believe me that my ex was a slime not that I was a money grubbing bitter ex wife.  She saw both kinds daily so I had to keep proving he was the db.  I didn't have to try to hard he does fine on his own.

    I didn't know about the IRS tip till later from another single mom at court for Deadbeats not paying CS.

  • So basically it is within my legal right to go to courts to ask if his income has changed

    He was employed with his ex co worker till 2007.. then he got another job that he has been with ever since.

    I did ask to see his income tax but of course he said no way.. either he was offended or has something to hide and doesn't want to pay what im entitled to, i def know he isnt struggling with his job now because if he was he would of asked for a reduction im supposing when he got his new job shortly after he left his previous one.

    As the sole parent and him paying child support, if i do find out his income tax return has shown since then he isnt making what he did at previous work place and is making more of a yearly income.. what would happen and what would my steps be??

    We did file our original custody agreement since i am here in canada with a family mediator ( they filed it to the courts on our behalf) ill see what they have to say.

    Thanks ladies i am married now.. but still have single parent issues...

    This. Also, it's often worth is to have your attorney run the calculation before you officially iniate the review. My lawyer told me that sometimes it can backfire and you can end up with less than you're getting.
