question for you about birth certificate signing on fathers side

So, here is the story,

My bother in law's girlfriend is pregnant.  they are together.  She is due at the end of July.  They both dont work.  (brother in law has some issues with the law blah blah)

The girlfriend has applied for some assistance for medical bills....His name being on the birth certificate came up the other day and my mother inlaw said to him he probably shouldn't sign the birth certificate so that the state can't come after him for money (as in child support)

There is no question that he wants to support the baby.  Why wouldn't he sign the birth certificate?  Even if he doesn't sign the birth certificate can they still come after him lets say they break up....can they still come after him?

I have no idea how to answer questions like this because in my husbands mine and my mind signing the birth certificate didn't even cross our minds. its just something you do.  ask me more questions so i can answer them for you i know this all might not make sense?

  • Why would you want to help him avoid paying child support? 

    To answer your question, it doesn't matter what he signs, the mother can get a paternity test and then he will owe child support no matter what.

  • I know i dont get it either.  I know my MIL will play it off like she didn't mean it that way...but i know her thats exactly how she means it.  Doesn't make sense and pretty f'd up.  I promised the girlfriend i wouldn't say anything but did tell her that if its brought up in front of me i will be putting my 2 cents in!

  • I didn't put my son's father on the birth certificate because we were not speaking when I had him.

    I filed for child support and his father could have just agreed that he was the father and sign the Acknowledgment of Paternity or a DNA test could be requested. His father wanted the DNA test. He was held accountable for the child support from the day I filed which was in August. The DNA test was in October and he didn't start paying until December but it went all the way back.

    Even if he doesn't have a job they would hold him accountable for something.

  • In Kansas, if you want help with certain assistance then you have to file for child support. But I think that's only if you want help with daycare.

  • Is there any possibility that she wants to make it harder for him to obtain visitation at some point? I'm not saying he couldn't get it, it would just be some additional hoops to jump through.

    I think your BIL should call the county child support/social services office and ask them some questions. If he's actively seeking employment and they live together, I'm not sure how they could force him to pay child support.

    Yes, they will make them establish paternity if his name is not on it.

  • In order to receive ANY state assistance (medicaid, food stamps, TANF), you must file and comply with child support enforcement. Failure to do so will result in sanctioning benefits for mother and child.

    Listing him on the birth certificate is a personal decision.  In some states if dad is not present they will not let you put them on because they are absent to sign. 

    I know Indiana has changed the law stating that if you are not married and the father does not sign the affidavit of paternity at birth then a DNA test must be done to assign paternity.  And the final cost will come back on the proven father, upwards of $500.

  • In Ohio an unmarried mom cannot put the baby's father's name on the BC unless there is a signed affidavit of paternity.  He can sign it willingly, or JFS will order a paternity test.

    If you receive benefits from the state, i.e. Medicaid, food stamps, daycare assistance, any child support received goes directly to JFS to pay for your "benefits" and the mom gets what is left over.
