NBR: Is it against the law?

So I've had a parent be a complete b!tch to me for the past three years. We just had student/parent/teacher conferences and she sent her child out of the room so that she could b!tch about me to another teacher.

She also revealed that she had secretly recorded a meeting we (she, the other teacher, and I) had a couple of months ago.

Is that against the law?

  • I don't think so. I thought you can record video, but not sound, if the other party does not know about it.

    But the whole "wearing a wire tap" kind of makes me think I may be wrong.

  • Depends on the state, but I would be contacting your principal and union. Regardless of legality, that it is BSC and you shouldn't have to deal with it.

  • I'm not sure if CA is different but in OH if you are a party to the conversation you can record it without the other people knowing.  Just as long as one party knows it's being recorded.  You can't place a recording device somewhere and "bug" a room without being a part of the conversation without a search warrant.

    Some states are different.  Other states you have to have a search warrant to record anything without another's knowledge.  

    If you are in a teacher's union I would definitely bring it up to your union rep. or attorney just to make sure!  I would also let your principal know what happened in case she tries to make false allegations against you!  At least you will have something on paper to CYA (Cover Your Ass).

    Bring it up to the admin. for sure. You are their employee and they should be looking out for you. This woman is clearly a little nuts, and creating tension in your work place. They need to step in and protect their teachers.
