Need advice/ encouraging words

I took a medical leave of absence from work to take care of my son when we received his cancer diagnosis. The doctor certified my medical leave for the remainder of the school year. I received a notice today to return to work next week or resign. I am just in shock. I don't know what to do. Going back to work right now isn't an option, but can they really force me to resign while I am on medical leave?I emailed the person who was supposed to be in charge of my leave to see why I got this notice. I also emailed my principal who had no idea I was supposed to be back at work either.I am just so in shock over this, I feel sick.

  • I'm so sorry you are going through this. How long have you been on leave? You should get at least 12 weeks from FMLA. Past that I'm not sure what you can do.

  • I am so sorry that you are dealing with this when your mind is needed in so many other places. Big hugs to you

As far as I understand it you are allowed to take 12 weeks fmla and they have to save you a position at your job. However, they do not have to save your same exact job if it is one that can not be vacant for that long of a time. I don't know what your exact situation is but I would have the principle get more involved and if they are not that supportive I would consider leaving. I know your priorities will not be with work right now.

  • I meant same exact position. I.E. you could come back to a diff. classroom or assignment and legally they are allowed to do that. I don't think that is being considerate of you and what you are dealing with but it unfortunately legal.

  • Under FMLA, your employer is supposed to hold your job (or an equivalent type of position) for 12 weeks, if your employer has 50 or more employees and you have worked there for at least a year. If you meet those qualifications, I don't know why they would give you such a notice....I'm so sorry to hear that. I hope that you get everything worked out so that you can spend the time home caring for your little boy.
  • Yes I am aware fmla is only 12 weeks, this was my concern when we first received the diagnosis because I had already used my fmla time up within that 12 month period for maternity leave. I asked about that when I applied for leave and was told I still qualified for medical leave. So I knew I had exhausted fmla but didn't think that mattered because HR told me I still qualified for leave.
  • If you exhausted your 12 weeks and take another leave prior to your rolling 12-month period being up, your employer dosn't have to hold your position.  Your HR department can still allow you to take a leave but they aren't legally obligated to save your position.  So sorry you are dealing with this!  I would definitely talk to someone in your HR department to see if you have any other options.
