This just in: My head exploded from frustration

Our temporary hearing is scheduled for next Tuesday.  Mediation hadn't been set yet because neither STBXH nor his lawyer would return any phone calls in order to schedule it.  Received notice today that STBXH has retained a new lawyer (this is #3) and they are going to try to push back the hearing.  Can he do this?  I was SO excited that we would FINALLY have something in writing...and again, the system is working in his favor.  To top it off, he basically told me last week that he will drag this out as long as he can so that he has time to "prove" to the court that he's taking the steps to better himself and stay sober.  All I heard was that he's going to try pulling the wool over the judge's eyes.

 I.could.scream.  And yes, I'm being overly dramatic, I know.

  • As bad as it sucks, he can certainly and continuously ask for a continuance. Doesn't mean that it will always be approved.

  • These antics will not amuse a judge.

    And if he is counting on all of this time to give himself a sobriety makeover, you can be sure he is still using.  I might ask for a drug test on his hair.  It will show his use over a period of time, not just the last couple of weeks. 

  • I understand your frustration.  My XH tried everything he could to drag out our court process.  When the whole court process started he had told me he would drag it out, make me spend all my money on lawyers fees, and prove that he is a mentally healthy/stable person who should have full custody of DD...he was certainly able to drag it out and cost me a ton of money, but I have full custody of DD and he still has supervised visitation.  Ultimately though, our judge had seen it all before and was quick to see that he was just trying to delay things and make it difficult...lots of judges do not appreciate their time being wasted.

    My advice, take a deep breath and know that he's not as slick as he thinks he is.  Judges have seen it all before and he's not trying anything new.  You just need to keep your cool and let the court see that you are the level headed, stable one.  Good luck!
