How long does CS through the county take?

I opened a case in early January. XH and I got notice in late February that withdrawals would be made from XH's paycheck starting in March, so he shouldn't give me a check. (I was advised to do it through the county because XH makes me beg every month, doesn't usually give me the check until the 7th or so, uses it as a leverage/control tactic, and just in general makes it an unpleasant exchange. This should circumvent all of that.) He told me yesterday that no money has been deducted from any of his checks. I kind of need that money to live. He gets paid every other Friday, although I don't know where he is in that cycle, and he wouldn't tell me. The county said they won't do anything for 45 days. Anyone know how long until I might expect a check? TIA.

  • It took a while for his employer to get the notice to start withholding it. He actually ended up being (and still is) a month behind by the time they started it. But if they said it was to start in March, I would imagine they gave the employer advance notice as well. Maybe he just didn't get paid yet in March. Once it did start, from H's pay day until the money was in my account was usually about 5 business days. He got paid on certain dates, so it was dependent on what days of the week they fell on. I hope it gets worked out quickly for you.

  • Do you get your CS payments through a paper check or automatic deposit? Paper check can take 5 business days from when it was withheld to receive. Automatic deposits are 3 business days (including the day it was deposited.)

    Either way, your support officer should be able to get you the direct website where you can check your "account" that tells you when payments have been made, the amount, how much is owed in arrears.

    Mine is through the DHS State of MN website. I have an account number and a PIN that I use to log in and I check the status of everything associated with what is owed and what hasn't been paid yet. If I hadn't known about this site, I wouldn't have ever known when payments were made as DB (like yours) wouldn't give me information on when he gets paid.

  • I don't have any advice but I just have to say that I'm pretty jealous of everyone that gets their CS so fast. Here I am, going on 6 months, and they still don't have an amount decided. He's even been very cooperative and turned everything in well before the deadline. It's ridiculous how slow this process is going!

    That's weird they're still deciding on an amount. We just went with what the CS calculator spat out. I knew that XH was not reporting his 5K-8K worth of annual bonuses, but by that point, I didn't care. I just wanted everything finalized. So, the amount is in our divorce paperwork, which got sent over to the child support division.

  • I opened my case on Dec 7 - it took just under 60 days.  There were some issues as far as the HR dept at XH's work knowing what to do.  At the end of January, they finally withheld something from his check, and it took about 10 days for them to send the money to NE CS Payment Center and for them to direct deposit it in my account...

    From the court date to when I received an answer on what the amount would be, it was 30 days and then another 30 days from when the withholding information was sent to his employer before it was withheld.

    Total, from when the CS information went out to when I got a first payment, it was over 6 months so it's not like I got it right away.

    Normally, the support workers take all of the information and have a max of 30 days from when they receive all information to verify it and get a "calculated" amount of what he could be paying based on income. Why it's taken over 6 months, I'm not sure. I'd call your support worker to see why.

    Are you going to court with him? If you are, are you sure that they're not just waiting for a court date before they can come up with an exact amount he'll pay per month? I know with ours, they had sent me the documentation showing what he *could* pay per month based on his potential income but what was actually ordered, it was way more.....

  • I havent been on these boards in months but am back again!

     Well, I have a support order that he is supposed to pay 75 a week.  This goes back to last year!  Guess how much I have gotten? About 100 in a year! It is literally a big fat joke, they call themselves the Child Support ENFORCEMENT agency but with him lying saying he has no job when in fact, he does and is working under the table, he supposedly has no income! He is over 9000 behind in CS and they aren't doing a thing about it! I just don't understand! In the beginning, everyone told me that they would calculate an amount to pay even if they did it with him working a minimum wage job.  My mom has talked about getting a lawyer, maybe that might kickstart things but I am so fed up with going to court and them looking at the roster saying, Mr. Barkley, your last payment was 7 months ago and you have not been paying child support so they set up another date in a month or two and threaten him with jail time if he doesn't pay but come that next court date, he makes a 25 or 50 buck token payment to keep his ass out of jail! I just don't understand.  I was called CSEA every week for months, thinking they would get tired of me calling and actually take some action, but Cadance will be 2 in 3 weeks and nothing is happening..He makes no attempt to see her cause he hates me and my mom so bad but he posts on his FB that he isn't allowed to see his child..um, OK!  He has made no calls or sent emails asking to see her so with him not seeing her and hating me and my mom, he isn't paying his support and he is getting by with it!

  • I'm way jealous of all of you ladies too!  I filed back in November and my first application was lost.  They had no record of it.  I filed a second time in January and still haven't heard anything.  I've followed up several times and I'm "in the que" to get an appointment date.  Wtf?!  So frustrating!!!!
