Legal Nesties-Will Question

DH's grandfather died in June he left his estate including the house 1/3 to each DH, his cousin, and DH's father. We have seen some of the money, but DH's father is still holding onto the rest. Things are pretty bad with me and his family right now so I am sure a lot of the withholding of the money is out of spite. Do we have any rights? Do we need to get a lawyer? We would rather not go that route. FWIW the will is probated in Atlanta! Is there a specific law DH can give them?

  • Is his dad the executor?  If so I would think you need a lawyer. 

    I am not a lawyer, though. 

  • The executor or trustee should be settling the estate.  If the dad is the executor you may need a lawyer.

  • Sounds like you have a right to 1/3 of the estate.  Sometimes settling an estate takes time (for example, the house would have to be sold and all related expenses paid before you would see 1/3 of that).
