My boss called me at home today on my last day of maternity leave to tell me not to go into my old office on Monday but to instead meet her at the head office for a meeting at 10. I know I am getting canned. They sort of let it slip before I left on leave (telling me they couldn't confirm if my job would be available by my return date) and they've done things while I've been on leave to confirm my suspicions. So, come Monday I will be unemployed.
I am freaking out about the money (though they'll have to give me a package - thank you Ontario Labour Laws), but I am secretly psyched I will be home at least a little while longer with DD... I was having a really tough time with the idea of someone else having her during the day instead of her being with me. I guess I am stressed and relieved at the same time.
Funny thing, as I melted down last night about today being my last day with her of my leave I prayed and prayed to God that I could just be home with her. Guess he works in some not-so-mysterious ways sometimes too.
Sorry for the rant - I can't say anything to anyone else (besides you lovely ladies) until it's confirmed.
Re: Fired on first day back from Mat Leave...
What a crappy thing to do to you at the end of your maternity leave. Couldn't they just have the balls to tell you before your leave started? That seems kinda azsshole-ish (new word, I know) to me.
I am happy that you're able to have time with your DD. I am envious. I really wish we could afford comfortably for me to stay home. I know I miss out on so many little things with Emma while I am at work.
God does look out for you even when it doesn't seem like it. Congratulations!
Yea it would have been nice if they told me two weeks ago even, we just purchased a new vehicle so I could get back and forth to work and now I don't know how we're going to pay for it. I need to find a job ASAP but at least I'll get a couple more weeks of bliss out of it.
Can you take the car back?
Did you pay for the car or is it a loan. It sounds like things worked out for the better.. scary money wise though
We're financing the car, but can't take it back. We were counting on the money from my job to pay for it. At least my severance will give me a few weeks to find a job. Fingers crossed I can find something, but it's doubtful. I was looking before this happened. LO's bday is on the 12th, so at least I will be home for that.
Trying to see the bright side or I'll go mad with stress.
Glad to hear you are in Ontario or else I might not have advice....they cannot fire you. By Ontario law (Employment Standards Act) they must give you your job back and if your job does not exist they must provide you with a job that is comparable in stature and pay.
You do not need a lawyer to fight this if you cannot afford one, you can file a claim with the Employment Standards Act and they will order your employer to pay you damages or reinstate you.
Even if they give you severance they cannot terminate you. (they most likely aren't paying you enough)
I have personal experience with this so if you need more information please PM me and we can chat further. We could email or possibly talk on the phone.
I am very passionate about this issue for reasons I am not legally allowed to discuss publicly. Please, please, please don't accept this without exploring all your options...contact me!

Also, I am not a lawyer looking for money, just have experience with this.
Even if you're OK with not working you are probably entitled to a lot more money than they are willing to give you voluntarily.

I PM'd you.
I was just about to say this.. I'm pretty sure it's illegal for them to fire you when you come back from maternity leave.

I feel your pain/joy. When DD was 3 weeks old, I took her in to work to meet everyone. The owner called me into his office and he said I was laid off. I was so consumed and exhuasted from the baby, that it didn;t phase me at that time.
I was scared financially but excited to not have to ship the kiddo off to daycare.
I didn;t persue any legal action, because my boss was also laid off. They got rid of all middle management.
They can eliminate whole departments, unfortunately, and even if you were on leave they don't owe you a thing.
It SUCKS!
They are in Canada. In the US, they can terminate you as long as it's not because you were on maternity leave- but they can if they were planning on eliminating your job anyway.
This is the statement that concerns me. I can't believe they were so irresponsible to say this to you. They HAVE to have a job for you when you come back. But regarding firing you after you return, I don't know much about that. Sounds like PP can be helpful with this info.
