I'd recommend "top dressing" with compost first (an inch or two...so the little seed have lots of good soil/nutrients to root into...and then overseeding. We've never worried to much about the birds. Be sure to water regularly (according to the bag) at first, until the little guys have a chance to sprout and root...otherwise, it's easy to kill them before they get established.
When we did it to some patchy areas, we added some good soil there first, and then used a seed product that had mulch/fertilizer with it. Not EF, most likely - but in my defense, I think it was before my EF days....
