So are you girls using your FMLA while you are on bedrest? I'm only on bedrest for 3 weeks, (once i hit 35 weeks i should be clear). Because its a medical leave, I have to dip into my FMLA so now the most I will get with my baby after maternity leave is 9weeks vs. 12. I'm so upset right now.
My vacation runs concurrently WITH FMLA so I can get paid right now.
I was really hoping I could just use my vacation first, and then dip into FMLA but doesn't look like that way.
This really stinks. I just want to fast forward the next 3 weeks and hope to see her soon!
Re: FMLA question and bedrest
My FMLA started when I went on bedrest at 21 weeks. It has since run out so my actual position at work is unprotected now, although they still have to give me a job (could be completely different hours) because I'm on short term disability. This also means I'll only get 6 or 8 weeks after delivery which sucks. I'm not happy about it, but it is what it is.
I just went on bedrest at 14 weeks. My office had the short term disability kick in right away ( after a 5 day 'waiting' period which used 5 of my sick days). So I am getting paid at 66% of my normal pay and then after 55 days it switches over to Long Term disability at 60% of my normal pay.
I believe the way they explained it to me was that since this is a medical pregnancy issue, its considered a disability and its separate from actual 'maternity' leave that is guaranteed by FMLA. So when I deliver in September, that will be a separate claim.
I am on California State Disability leave (paid at only 55% of my regular salary) and will remain on that for as long as I am on bedrest (may be for the duration of my pregnancy totaling up to 11 weeks or I may possibly be able to return to work in the future- it is all unknown). I will then qualify for 8 weeks more short term disability leave (thru state of CA) after the birth of the baby and 6 more weeks Paid Family Leave (through the state of CA). After that time I plan to use my 10 weeks of saved PTO. It will be a struggle financially to only be paid at a small percentage for a number of months, but we are hoping it all works out.
The only hitch is that my job only allows a 6 month leave of absence from your job and after that nothing is secure and your manager may or may not grant you an additional personal leave. SO, it may be that I only get 6 months off (6 months that I was planning to spend with the baby from June to December) and now I may only get 3 months with the baby since 3 months will be spent on bedrest
It is beyond devastating to me and I try not to think about it too much or I fall apart.
Sorry you are going through this. It, to me, is the hardest part about bedrest (reducing your maternity leave with the baby once he/she is born). Hang in there.

Another thing to think of if you have a flexible employer...FMLA requires they give you at least 12 weeks, but doesn't say they can't give more depending on the circumstances. For example - I have worked for my company more than 11 years and will loyally stay here longer. I am on reduced work hours, using 2 hours of FMLA leave a day, which runs concurrently with my sick time. If I had to go on bedrest all together, my short term disability would kick in and then sick time could supplement so I could receive full salary. My employer could subtract all that time I was off from my FMLA, and I could end up with less time after the baby comes....but they are not going to. I am still getting 12 weeks of maternity leave after, no matter if I go on bedrest and use up all my FMLA before....
I know my company is an exception in a lot of ways (my 12 weeks of maternity leave is 100% paid, etc.)..but maybe if you talk with your supervisor/HR department they can work something out for an extra few weeks?
