Mine will be. He is only about 36lbs and about 40-42 inches. He is comfortably harnessed in his Graco Nautilus. I must admit to wanting him to be in just a booster w/ the seat belt, but I know he is much safer in the 5 pt harness.
He won't be (he'll be 5 in about 5 months). We moved him to a booster at about 4. But, he's really big - and too tall for the 5-point on the Nautilus. He was 44 inches and 48 lbs at his 4-year checkup.
On the other hand, my teeny DD (who's only 25th percentile for weight at 2) might be...
DD will be. She's 4 and 32 lbs. DS won't have to be (4 and 38 lbs), but for the sake of my twins having the same thing=fewer arguments so I'm sure he will be too.
I plan on keeping her in it for as long as the straps allow. I'm just not comfortable with idea of putting her in booster. My idiotic neighbor whose daughter turned 3 this past november & is super tiny has her in a booster. I cringed.

Yes. He'll probably be in a 5 pt. harness for at least a couple more years (he's small.)
That being said, I do allow him to ride in a booster seat when he's going home after school with a friend or otherwise riding in someone else's car. I'd prefer him to be in a 5 pt. harness but I figure that other people are going to be more likely to correctly use the booster seat than they are to correctly get his carseat installed into their vehicle.
DD is 5.5 and still in a 5-point harness. I may try her in a booster when she's 6, but we'll see. She's really wiggly/antsy (possible ADHD) and I'm thinking she won't be able to sit up straight and not wiggle in a booster... especially because we like taking road trips and long car drives.

Yes, Eric will be 5 next month and still in a Britax Marathon and Sunshine Kids Radian XTS (both 5 pt harness carseats). I get a lot of questions as to why he is not in a booster yet. Most people I know with kids his age have already transitioned to a booster. He is only 36 lbs. so I will keep him in a 5 pt for a while (even though a booster would be so much easier!).
DD will be 5 in August and will remain in a 5 pt harness for several more years. So many seats allow for extended harnessing that I cant justify not keeping her (and DS) in a 5pt as long as possible.
DD is similar in size to your DS (38 lbs and 43"), and she'll be 4 years in 3 months. I'm hoping she'll be able to stay harnessed until 5 years. She's already been telling me that when she's 4, she'll be able to use a regular seat belt. I might get a booster for my sister to use when she has to help us out and pick her up from daycare, but we only live 3 miles away. I have to talk to DH about buying the new taller Frontier when it comes out.

He's tall and close to 50 lbs. He was 42 lbs and 44 inches at 4 y.o.
He's in a high back booster once a week when grandpa takes him swimming....
