Adoption

Not sure... Got some questions..

I am expecting and the father is not around. I am in a relationship and we're due to be married when he returns from deployment. We are wanting to give the baby his last name, but are unsure how this works and what we need to do to go about doing this. Anyone been there, done that? Anyone have information on the legalities involved? We'd appreciate some feedback!

 P.S. We'll be married before baby is due and we plan on talking to family lawyer, but want some pointers prior. :)

  • Well, to be honest, you can name any father you want on the birth certificate.  Bio or your husband.

    Even if you put the bio father down, you can give the baby any last name you want as a legal name on the birth certificate.

    Legally, if you do the second and want an adoption, the bio father would have to waive his rights or not step forward during the specified time period for your state and then the attorney would petition the court to let your husband adopt the baby.

     

  • I'm not positive about your state, but several states have a law that states that whoever you are married to at the time the baby is born is the legal father. ?Since you will be married before the baby is born, this would solve that issue. ?Please check on your state to see...
