Godparents?

3rd tri got me thinking about godparents, we have some close friends that are due in Jan, with a little girl. We plan on asking them to be DS's god parents but he's already almost 5 weeks old, should we ask soon. We aren't doing it at all for religious reasons, because we aren't religious people. We want to do it for legal reasons so he doesn't end up with any of our family. We would much prefer our children to go to close friends who have  child close to DS's age. 

Once we ask them, do we put it in our will? what is the legal procedure to make sure DS does not go to family in the event of our death?

 

Sorry if this is stupid, I just have no idea what the steps are.
