It is illegal to ask anyone if they are pregnant or what their intentions are regarding having children. Someone could be 9 months pregnant and it is still illegal for a potential employer to ask if she is pregnant.
Actually, the question itself is NOT illegal. Using the information, or treating an employee any different because of the answer -- THAT's illegal. Which means asking the question is dumb. If the employee experiences any negative treatment at all, they could claim it was because of their answer and possible pregnancy, and the employer would have a hard time proving that information didn't play a role.
Illegal? No. Stupid? Yes.
Is it a potential employer or current employer? Current employer can ask what they want - but can't treat the employee differently because of it. Potential employer is opening themselves up to litigation by asking it.

what does that even mean? What does freedom of speech have to do w/ a job interview by a private company?
I work in medicine and have been asked that twice in two seperate interviews (both by males). I know it is illegal, but it is also hard to prove and get justice. Working in a male dominent profession I know this plays against me when going for interviews. I don't like it, but I don't know how to fight it.
