Work in a small office? I'm trying to determine if I am eligible for anything under the FMLA. I have worked the required hours and length of time but this is a shared law office and doesn't employ the required 50 people. So am I just outta luck?
It depends on your office. My company does offer FMLA type benefits, but they could choose to change that at any time. I'd ask your HR department. They are not required to comply with FMLA if they employ under 50, but they can certainly choose to do so.
We don't even have HR. Its an office full of attorneys and their assistants. I guess I'll just hope they decide to be nice. They usually treat me pretty well (ie. Christmas bonus, wedding gift) so here's hoping! Otherwise we have money saved to cover that time.
LEGALLY FMLA only covers companies of 50 or more people. However, since FMLA is unpaid leave most companies will honor a request regardless of the provisions. Unless they foresee you never coming back then I don't see why they couldn't get a temp. to fill in for you while you're gone. In this economy they shouldn't have a hard time finding a temporary employee with the understanding that he/she will only be there a few months.
GL!!!! I wouldn't stress over the legal aspect of FMLA until you know that your employer is unwilling to work with your requests.
I'm pretty much in the same boat as you. The company I work for is really small. BUT, they do have the FMLA stuff posted, so I assume that means they plan to go by that. I havent told anyone other than my direct supervisor that I'm pregnant yet. I plan on telling them in Feb. and figuring out what my options are then.

They treat me really well normally, so I am hoping that we will be able to work out some type of short term disability thing. Best case scenerio, they lay me off and I can collect unemployment!
