FMLA ?

Ok, so I work for a small law firm. There are only 5 of us working in the office. We are not covered under the FMLA, but does that mean my boss doesn't have to give me the time? The rules in the FMLA don't really say anything about those employers with less than 50 employees. I think he will give me some time, just want to know what I should/could ask for in this instance.

  • It means he doesn't have to hold your job for you while you are out.  Ask for whatever you want,  many companies will let you take 12 weeks even if they aren't required to(unpaid of course)

  • In your situation it will be totally up to your boss and they don't have to hold your position for you. Hopefully you will still be able to take up to 12 weeks.
  • That's what I figured. Thanks ladies! I work for a Real Estate attorney, so I couldn't find anything in what we have around here. I knew all I would have to do was ask you. Big Smile Now to get the guts enough to ask about it.

  • Good luck!  I wasn't covered by FMLA either and asked for 8 weeks off.  My boss approved it and then during my maternity leave, he called me at 5 wks and told me that if I didn't come back at 6 wks I wouldn't have a job.  Angry  I called his bluff and he held my job.  Hopefully you have a nicer boss than mine.

    That's what I'm scared of! My boss isn't all that nice. He has his nice moments though. Hopefully I'll catch him in one.
