Babies: 0 - 3 Months

so before i call a lawyer...

I have a question maybe some of you ladies can answer. The father of my LO and I are not together, a few weeks before her birth he still wanted to be a part of her life. Long story short, she is 3 weeks old today and he has yet to meet her or make an attempt to meet her even after all my countless attempts to get him too, I even offered to drive the 2 hours up there with her. I left one last message for him this morning and he is still ignoring all my calls. He obviously wasn't there for her birth, didn't sign her birth certificate papers or the paternity papers. I don't want support, I don't want anything but for him to sign his rights over. 

My question is does he still have rights since he didn't sign anything or do I still need to go through a lawyer to have official documents made that he does need to sign that states he has no rights?

  • I would contact your birth registry department at the hospital you delivered at and see what they say.  They may be able to steer you in the right direction since they are the ones that have to file everything, etc.

  • Im just guessing here.. but if he doesnt sign anything giving you full custody even though hes not listed as the father in days weeks or even years he could want custody or something along the lines of that.. so its better to get it out of the way now I would assume. Instead of when shes 10

    I asked them before I left, everyone I talked to seemed clueless, all they made me do was sign a release form for the paternity papers stating why the father didn't sign and why they couldn't file anything.

    Yes but it wasn't his family, it was my grandparents on my fathers side.

  • I would call a lawyer seeing as he may be able to get a petition for a DNA test to prove he is the father.
  • definitely call a lawyer. it varies by state, but just know that this is a very tedious process, even if he agrees to sign away his rights. good luck. :)

  • I would call a lawyer to get him to sign over his rights but you might be able to get some child support too, even if he does not want to see your LO.  Beautiful by the way!
  • I do this for a living here in Ohio

    Here, until he declares that he is the father, he cannot sign his rights over. right now, until he comes forward, he has no rights.

  • Family Law can vary significantly from state to state.  I would speak with a family law attorney in your area.  GL and you have a beautiful baby!
  • I believe you have to go through the "abandonment" paperwork if you don't want him in her life. My aunt had to do this. From what I remember, they send him paperwork, and if he doesn't respond, she's yours.
