Daycare contract

So DH and I have decided on a daycare option, a friend (I guess more of an acquaintance) had a baby last Sept and is a SAHM now who has volunteered to watch our LO for the two 1/2 days a week we'll need her for.  She also watches a little boy one day a week.  I told her yesterday I'd like to make a contract so neither one of us gets screwed in the end and she thought it was a good idea.  Here's the question- what should I put in this contract?  I know the usual pay, vacations, notice if she's no longer able to watch our baby.  Is there anything else I should put in there?  TIA.

    THIS AGREEMENT is made on February 18, 2009.

     

    BETWEEN:

     

    XX

    AND

    YY

     

    Where the following is agreed:

     

    Period of Service:

    The position will begin on March 9, 2009 for a period of 12 months. In the event that either party cannot fulfill the year long commitment, a one month notice will be given.

     

    Duties:  

    You will look after XX during the hours stipulated and undertake all duties associated with his care. While XX is in your care, you will have the responsibility of only looking after (her child) and XX. After approximately November 15, 2009 a second child from the XX Family will also be covered by this agreement.

     

    Paid Time Off:   

    You will be entitled to two weeks (6 days / $90 per day) paid time off to be used as sick and/or vacation days.  Advance notice is preferred whenever possible for vacation/sick days.  You will not be paid when the XX Family is on vacation or on holidays, unless you choose to take these days as your paid time off.  The XX Family is on vacation an estimated 4 weeks per year.

    Thanksgiving Day

    Day after Thanksgiving

    Christmas Day

     

    Expenses:   

    Any reasonable expenses that XX or the second child incurs while under your care will be covered by the XX Family. Please let us know in advance of any expected expenses or as soon as possible.

     

    Hourly Pay:   

    $10.00 per hour for one child

    $15.00 per hour for two children

                                                                                                             

    Hours:   

    March ? August 15 (approximate)

    Monday, Tuesday & Thursday, 8:30 am ? 5:30 pm.

    Approximately 27 hours per week.

     

    August 15 ? November 15 (approximate): ?Maternity Leave?

    Tuesday & Thursday, 8:30 am ? 5:30 pm.

    Approximately 18 hours per week.

     

    November 15 (approximate) and forward

    Monday, Tuesday & Thursday, 8:30 am ? 5:30 pm.

    Approximately 27 hours per week.

                           

    Additional Details:

    -          Actual hours worked may vary slightly week to week.  Weekly pay will be paid on Thursday of each week in accordance with the hours worked.

    -          Diapers, wipes and a car seat will be provided for all children for use while in the employee?s care.

    -          Lunch, drinks and snacks will be provided for XX by the employee. Formula and baby food will be provided by The XX Family for baby #2.

    -          You agree to pick up/drop off XX occasionally as needed from our home. This will always be discussed in advance.

    -          When the second child arrives, you agree to pick up the children from our home each morning.
