FSA and daycare

If you use a "home daycare" but its really just a person or family member sitting your kid - no special business just a sole proprietor say  - and you are paying them, can you still use a Flex Spending Account for those daycare costs?  Or does it have to be a certified daycare person/establishment? Or does it depend?

  • Yes, you can but that person should be reporting the income on their taxes because I think that you'll need to give the SS# on the reimbursement request so the IRS will know about the sitters income.

  • If they are not paying taxes on the money you will screw them over if you do b/c the IRS will go a tap tappin at their door to collect :)
