Ok, I have the answer.  Yes, it would be illegal for them to marry.  If they did get married, their marriage would be considered void.

Thank you for that!  I asked my dad (retired attorney) but he didn't know what the rules of civil law were.  Such a horrible situation!  I guess last night he told his mom what was going on and she really freaked out and told him he had to stop this now and not ruin this poor girl's life and his response was "I will take that into consideration"  UGH what is wrong with him.
