FMLA Question

I'm hoping someone may have some experience with something similar (or maybe employment law)...

I have an opportunity to apply for and obtain a new management position at a fairly large company in the next month or so. The problem is, I won't qualify for FMLA by the time I have the baby. I was thinking that I could apply and interview to see if they offer me anything. But after that, at what point do I ask about FMLA or tell them about my pregnancy? Can they let me go when I have the baby or require me to come back when my vacation is up (a week or so - not sure what I would accrue by March)?

Re: FMLA Question

  • I agree with pp.  I would interview, and after they offer you the job when you are negotiating salary negotiate maternity leave as well. Best wishes!

  • I agree with what others have said. Go through with the interview and negotiate the time off once you have the position. It also gives you the opportunity to truly see what type of company this is and if they understand family/life obligations. Good luck with everything!
  • Thanks ladies, that was my initial thought. My mom thought I should start first, but I want to keep my existing job and benefits if the new place isn't going to work with me and I feel like I can do that post-offer/pre-start date without endangering my family.

    I think that's what I'll do.
