Kinda OT- what would you do--UPDATE

Okay, so I figured I would get good advice here as I am in a dilemma.

We are closing on a house. Original scheduled date is Late September. Owner asked if we would move it back one month to late October. My due date is November 27th, but most likely will go the week before due to my age acc to doctor.

I am in a dilemma on what to do. We are currently renting and our lease is up mid November, so we have to pay rent until November anyhow. It would save us money to postpone date (mortgage would be due a month later and owner will pay us rent for that month) Downside, I am pushing it dangerously close to my due date..and of course, the nursery would have to be done in a hurry.

What would you guys do? Any things you think I should think of?!?

Thanks everyone for the advice. SADLY, the owner has canceled the deal on the house without any warning, so we have to start over....hormonal old me has cried all afternoon over it now...Just so upset as we received zero explanation about why the deal was canceled. The owner canceled deal and re-listed house a few hours later....

I would postpone it to Oct and then see if you can keep renting all the way through end of Nov. It might give you a little more flexibility so you don't have to rush to get out of your current place by mid Nov. Like ThoseThreeWords said, I'm finding this last month is really draining. I have to do everything slower than normal and I can really only do 2 or maybe 3 hours of activity at a time and then I have to stop and rest or take a nap. I can keep going for a few hours after I rest, but at this point, I have to do things in spurts like that.

I agree with PP. The nursery doesn't have to be completely done in advance. LO won't know the difference! I would save the money and move in later. More $$ = more diapers!

I agree with what the others have said but just wanted to chime in on mortgage conditions-- do you have a rate lock that will expire if you don't close end of Sept? Just check with your mortgage broker to make sure this won't cause funding issues.

Thanks for advice everyone. I definitely have to find out about interest on loan. I hear prices are expected to go up so that could be a BIG concern..Good point.

Just need to write for my own sanity. I have cried all day long over this stupid thing (damn pregnancy hormones). 

I spent the last week spending my vacation getting ready to close on this house that we bid on last week.Much to our excitement, owner agreed and signed contract despite her initial resistance. My husband has been out of town on business so I have been stuck spending all my freetime running places, emailing people, faxing stuff, etc so we could close on this house. Needless to say, it has been a stressful week but figured it was well worth it to know I would have my dream house to move into before the baby is born. Yesterday, we received this super detailed letter from the owner about the house yesterday describing every update she has done to house. It was such a meticulous letter clearly showing how much she loves her house. It described her situation and why she was moving due to retirement and building a new house out of state. In the letter, she asked us to consider changing closing date. Her reason made perfect sense to us so we wanted to try to consider it. For obvious reasons, we felt torn about changing the date (thus the reason for the post). Anyhow, that was less than 24 hours ago where it was even proposed. My husband flew home for the weekend (busy season for him at work) so he could be present at the inspection tomorrow morning. We met with mortage guy today to finalize paperwork and then out of the blue, our lawyer calls to tell us that her lawyer called to say the "deal" is off without any explanation from the owner. I am devastated. She didn't even tell her own realtor that she did this, nor will she even return calls to her realtor to explain. 

I am out time and money and lost out on the opportunity to bid on another house we also liked as that one was sold this week. We literally have to start over which is devastating as my husband's work schedule makes this almost impossible to do right now. as his availability to look at houses is challenging. 

I have literally cried all day.  In her 3 page letter, she gave me her email address and phone number. It took every ounce of energy I have to not email her. I figured it would just make matters worse and I regret it in the morning .

I am so, so sorry. I would be really upset, too. I am not sure it would help at all to email her, but it seems rather fishy that she put the house up on the market again. Does the contract she sign then not count for anything? Have you talked to your lawyer to see if you have any options? Maybe someone on this board can offer better insight/advice. ::hugs::

That really sucks. If you had a signed contract, can she even do that? Normally there's only a very brief window (if that) when either party can just change their mind, then the only way out I think is contingencies. At least when we bought our house in our state that's how it was here. I'd definitely talk to your lawyer about it.

Sadly, we hadn't done inspection yet so she still legally had an out. We are out lawyer fees and the cost of radon test. Our lawyer said she has no legal obligation to pay. It's sad. I had to put down 10,000 to prevent ME from backing out but she can just do it on a whim? It seems so unfair to me right now.

I just wish i had some type of explanation. It is all just so weird. She went out of her way to write us a detailed 3 page letter and within 24 hours, cancels the whole thing without any type of explanation at all. makes no sense at all. Her realtor said she tried to call her 20 times to find out what happened. She won't call her back either. She canceled entire thing through her lawyer without even telling her realtor

How utterly frustrating! I'm so sorry this happened. FX that you will find a different house that you love even more, that's in-budget, with a more emotionally-stable seller.

That sucks that it fell through. Did they give you a reason? edited: saw your update that sucks. Did you have it out of attorney review?

Oh my gosh that sucks. House buying is so stressful because they make the seller promise the moon and the buyer has so much power. I'm so, so sorry. I too would be crying over this!

It got even WORSE, believe it or not! LOL

My husband emailed the woman wishing her luck and telling her how upset I was to see deal fall through.

She emailed him back today and said that she was sorry it didn't work out but that she had tried to change closing date and that we were uncooperative. We were DUMBFOUNDED because we didn't know she wanted to change the closing date until the day before it totally fell apart. (and we clearly were open to negotiating on it) We instantly called her on the phone to say "OMG, it's about the closing date..Let's figure it out"

She spent 30 minutes or so telling us how the real estates agents all lied to us and how we shouldn't have trusted them to deal with the closing date. She was basically insulted we did not respond to her letter personally and chose to deal with real estates agents instead. Finally, my husband said "okay then. NOW we know we both are fine with  a new closing date. do you still want to sell us the house?" and her response was "ohhhh I have another offer"

She gave that whole speal about how it wasn't her fault it fell through and that it was all over the closing date, when the truth is, she had another offer the whole time. She was just trying to make herself look good by backing out. 

What a waste of time and energy..and money

Did you ever go into attorney review or just an accepted offer?  

I am in the middle of selling my home and buying and it is very stressful.

BTW IMHO you shouldn't be talking/writing to the owner at all and she shouldn't have contact with you at all.  (That is what the realtors are for.)  Do you believe that your realtor was lying?  If you do you should get a new realtor.  I think the owner was cray giving you demands on a house she was selling.  Really you can't take it personal when someone buys your home and changes things.  It is a business transaction not personal!

I guess we were in the 5 day period of "attorney review". she had accepted and we have that contract. We had started the Radon inspection and were scheduled to do regular inspection when she canceled.

Apparantly, legally she has that right.

Sadly, the law protects the seller and not buyer. We put down earnest money down and will have to wait to get it back, yet we are stuck paying for a radon inspection on a house that she never planned on even selling us. THAT sucks ...oh, and whatever lawyer fees we have accumulated because of this mess

Totally agree at this point. What happened was she somehow got our home address (from paperwork, I guess???) and she sent us that personal letter.

When we got it ,we immediately contacted our realtor and told her. We gave her a copy. We had no contact with her at that point.

when the deal fell through and we had ZERO answers why, my husband reached out and emailed her without telling me since her email was on that letter. 

When she responded today, he showed me and that is when we found out that she "claims" realtors lied and the deal fell through based on closing. We emailed realtor immediately and at that point, she told us she felt the other person's realtor was lying, and perhaps we SHOULD call her.

We called her then.

This had jaded me on the whole home buying process. I hope it gets better

Oh it has been a nightmare.

We were still in the "5 days" so I guess she had a right to cancel it. There has been so many stories on this debacle, I have no idea who is even lying anymore. Woman claims realtors screwed us over, but one of the emails she forwarded us clearly shows how mad HER realtor was at her for canceling the deal. Her realtor has always claimed she had no idea she was "canceling' until after it was done and claims the woman won't talk to her.  

It's very confusing and I am now 6 months pregnant with no good prospects on finding a house at this point. I currently live in 1 bedroom apt, so I am understandably stressed out on what to do when the baby comes now.

I have tried looking at houses two days in a row, and that is hard. As you can suspect, every house is being compared in my head to that one. We looked at one that was $20,000 more that the one we had and was filled with 80's wallpaper EVERYWHERE, was tinier, and needed thousands and thousands of dollars of work..OMG, it was horrible..

I believe there's a reason for everything. I understand being upset about this especially at this stage of pregnancy but maybe there was a huge hidden problem with the house and had you gotten it, it would've been a nightmare to deal with! Huge hugs! I hope you find what you're looking for and that it end up being nicer, bigger and cheaper than that lady's house!

So sorry you are going through this. I would see if you can go back and recover some of your money that you lost. What is your realtor saying about all this? Seems like she should be more involved with this mess.
