I am not sure if this is the correct terminology for what I would like to do but I need some advice.  I have been speaking with a few people about step-parent adoption and was moving in this direction.  I am now considering just having DH legally made DS's guardian in the event that something happens to me.  I would like all my rights, responsibilities and custody transferred to DH in that instance with whatever current visitation agreement with BF to remain in place.  Has anyone done this, how, and who did you contact for this?  Would you advise reaching out to BF to reach this agreement or pursue it directly in court?  BF has little regular involvement and has been less than willing to agree on anything else even in the courtroom although his unwillingness to parent may make him agree to this.

  • You should appoint DH as the guardian of your child in your will. Be aware that it is not binding on the court, and if your child's biological father wants custody, he is likely to get it, even though your DH may be able to establish regular visitation.

  • My dh wants this as well but it looks like the only way to make it legal for me as a SM to have the boys and not BM is with step-parent adoption. We're looking into this process but our case can be grounds for abandonment, since it's been a year without contact between BM and SSs. I also look for any advice others have to offer on this.
  • Thanks to those that have commented.  I am still researching and looking into a consultation with a family lawyer.  I will update when I get more info.
