How to handle two moms and a birth certificate

So I know its a little early to deal with this I'm kinda scared about this part because K is worried that since the baby is coming out of me then it won't be hers too.... So since in Ohio you can't put two moms on the birth certificate how would be the best way to go about this? I was thinking a POA but I wish she had more...

    We are in Ohio and currently 17 wks pregnant. My spouse is carrying.

    Same-Sex marriage is banned in Ohio and the issue with birth certificates is not two females but you may not adopt a baby together if your not married. Technically in the eyes of the law, I will be adopting my baby so until they lift the ban, unmarried spouses will not be able to be on the certificate.

    BUT in august they are revisiting the case, so this could change.

    But, since the laws are different in every state, you really just need to speak to an attorney who is well-versed in LGBT legal issues in your state to find out what will best protect both of you.  I also live in Texas and we just completed the second-parent adoption process.  Before the adoption was complete, we had papers drawn up indicating my intent for my wife to be the adoptive mother of our son in case anything happened to me before the adoption was consummated.  We also have wills and all of our POAs drawn up.  Good luck!

  • I agree with PPs, contact an attonery in your area to discuss your rights and what you both need to do to protect yourselves and future child(ren).

    For us, we live in a state that has a whole ban on gay marriage thing going on. But a little research, there is no express ban on a gay couple completing a second parent adoption. Judges can refuse to process it, so our hope is to get in front of a judge who isn't ya know...an ass. FI will be on the birth certificate (obviously) and then I'll file for second parent adoption. But that can take...as long as regular adoption, so we'll have legal documents that state I'm the child's legal guardian if anything happens, we already have wills and POAs in place so we'll be updating those too. Luckily we're using a known donor who is my BFF and wouldn't try to stop me from being her other mom should anything happen to FI.

  • I am in Texas. While I was pregnant we had a variety of legal documents drawn up that would protect my partner if anything happened to me between the time the baby was born and we completed the SPA. Things likes will, power of attorney, medical power of attorney, and guardianship documents. We used a lawyer that routinely does these for same-sex parents and does them for a set rate. You should definitely consult with a lawyer. If there are any GLBT parenting groups in the area they probably can give you recommendations concerning lawyers.

  • We live in NC, also a state with a ban on same-sex marriage.  24 weeks pregnant and working on finding an attorney.  Makes us so angry DW (we married in NY) will need to "adopt" our twins.  She's their other mother; she shouldn't have to adopt them.  Come on, marriage equality!!
