My 4 year old son is not biologically my H's, though he has been in his life since he was 10 months old. His biological dad sees him once a week, if he's lucky. But per our divorce decree, he has him "every other weekend, one night a week." (Laughable) For that reason, I have been in contact with my attorney, figuring out the steps to take him back for sole custody. Clearly our definitions of shared parenting weren't the same. That's fine.

Anyway, our now blended family is going on our first trip via plane ride at the end of June. Will I run into any problems flying with him? We don't have the same last name. We are not flying internationally, so no passport is required. 

I left a message for my attorney just to be sure, but was curious about other experiences.

    I have flown many times w my dd with her different last name and never a problem.

  • We travel a lot and have never had a problem. If we travel internationally, we have the BM send a note but it's never been requested by any travel authority. FWIW, we all have the same last name so that makes a difference, I'm sure.
  • I've flown with both my DD and my SD at the same time (DH wasn't with me). DD has a different last name, SD does not. So even flying with 2 kids with different last names, I was not questioned. I did carry their birth certificates and CO's just in case.
    DD(14),SD(13),SS(11),SS(9),DS(3)

  • I have a different last name than my kids and have had no problems. If it makes you feel better you could bring along birth certificate, maybe your marriage certificate or something.

  • You should not have a problem unless there is something in your orders that restricts where you can take you children. It's always best to keep a copy of the orders with you.
