Feel terrible about having to let nanny go.

We are doing a nanny share starting when my maternity leave ends in 3 weeks. The other couple had been using a nanny for a couple months. And i had been using her to help out a couple hours a week. We were going to use her, but it turns out she can't get work authorization in time. (Immigration issues and it's a nonnegotiable issue for me due to my career) I feel horrible about it. I'd love to hear about anyone who had to let a nanny go, especially when it wasn't due to performance. Severance or notice? How did you do it?
My TTC History:
2009: missed miscarriage #1 at 9 weeks (trisomy 16)
2010: Infertility
2011: Diagnosis and treatment (low sperm count, anastrozole for DH, clomid for me + IUI)
2012: Baby #1
2014: Baby #2
October 2015: missed miscarriage #2 at 11 weeks (trisomy 22)
March 2016 BFP#5, due November 2016.

    If she's not eligible to work in the U.S., you can't worry about severance or notice. She knows her immigration status and her capability or lack thereof to work without proper authorization. So she shouldn't be shocked to learn that you can't hire her. 


    I'd be concerned paying her severance if she doesn't have proper authorization to work at the time you are paying it to her. You don't want to cause issues with her status going forward if paying her severance violates the terms of her visa. 

    PS I'm an immigration attorney. 
    Stupid question, but is there a threshold of salary where you don't have to check immigration status. Like could someone hire her as an occasional babysitter?
