Let's see if it sticks this time

So the CS agency in TN took DC back to Court for Contempt.  He had "promised to pay" when they went in Oct. 2012, and that didn't happen.  So they took him back to Court in Sept and he made a payment of $200 and they continued the matter to December 16th.  Guess how many payments I've received since then?  Exactly.  Let's see if they follow through and actually DO something this time.

He already booked the kids' flights for 12/21 and 1/3.  So now I'm curious:  if he is found to be in contempt of the CO and they actually penalize him with jail time (like they've threatened), do I still send the kids?  I know they won't actually put him in jail, but one can hope, right?

  • They can actually put him in jail. If he has a job he could get work release, but if they wanted to, they would.

    I'd wait & see what happens. Here's to hoping!

    He works as a contractor, meaning he gets paid in cash which is why they've never been able to garnish his wages.  If he were to say he needs "work release" I would certainly hope that the CS agency would demand access to a bank account.  But they haven't yet, and he's well over $25k in arrears.  I'm not holding my breath that they are ever going to actually punish him.  But man, that would be an amazing Christmas gift...

  • Sounds like Indiana. They will actually put him in jail and let him out for work release to pay CS. With a cash job though I don't know how they would do that. Maybe he would have to have his hours verified by a supervisor it something? Good luck!

    Yeah he's his own supervisor.  It's total BS.  

    I know I'm a cold-hearted person for saying this, but I really want him thrown in jail for awhile.  If you're not going to support your children for 7 years, some of your freedom should be taken away.

  • I completely agree. BD has only gone about a year and a half without paying. The next step for us is having him sent to jail too, but I've left it alone since he has been MIA for a few months. Call me a bitch but if he wants to come back around I'll be filing for sure.

  • my sks bm actually spent 3 weeks in jail recently for non payment of child support, so there is hope for you too!
  • We are in TN, and no one we know of who has ever been threatened with jailtime has ever actually served. Shoot, they even gave BM a choice a serving 10 days or 5 weekends on a probation violation, and she did not have a job to work around our custody of children. She was in court for arrears three times last year for her other two children and her parents always paid the minimum amount required at that time ($200-500) and never ever made another payment. She will never pay us a dime either.

    For the first time ever, I'm actually inclined to listen to DH on this. No point in even pressing it (for us anyway). All it would do is sure things up for SD, and things have finally settled enough for her to be living a fairly normal life.
