WWYD Apartment Question...

I seem to be popping out every weekend with a question, but it's when things seem to happen, so here goes-
The woman who lives above us have overflowed her bathtub three times this month.  All three times, we have woken up or noticed that we have a stream of water flowing into our guest bathroom.  We have been lucky enough to catch it early and get a bucket under it each time.  We now just keep that bucket in there because it is becoming a pattern.  We have spoken to her (she keeps falling asleep when she's running a bath--she's a strange one) and contacted the apartment complex about it the first two times.  They talked to her about it and did some minimal clean up the second time with a fan on the ceiling and repainting, but here we are again.  What are our rights at this point?  Do we just keep dealing with this and hoping that we are here to catch it when she does it?  At some point her floor/our ceiling is going to just cave in.  Also, we are going to be out of town for the holidays a lot soon.  I can't imagine what would happen if we weren't here to catch it.  Tonight I had to knock loud enough to wake her up so she would go shut off the water.

  • I'd contact your housing authority and see what your rights are. Things vary by state.

  • That's good to know.  I imagine they can't do much.  We are going to see if we can get a mold inspection.  I guess we'll just leave a big bucket there when we go out of town.  This is ridiculous.
  • You should have habitability rights no matter what state you are in. Since this sounds kike a safety hazard (sounds like electrical issues possibly) you could probably break your lease without repercussions if that is a route you wanted to go.

  • I agree with @Zoeylucy...I'd ask to move to a different unit if that's a possibility.

  • I really want her to move. Last night she kept saying she needs to move off the third floor (as if that is the problem). I'm like, you still shouldn't flood your bathroom, but go for it. Ugh. Other than that, I love our apartment. I am starting to miss a house for the yard and space, but this place is pretty sweet.
