Revocation Period

A friend of ours is exploring DIA and signed up with a local agency. My DH went and talked to them about their experiences so far since we are more than likely looking at adoption for ourselves in a few months. I've already done a fair amount of research on my own and through lurking this board and you wonderful ladies. They told my DH that their adoption agency said that the papers could be signed BEFORE the baby's birth thereby effectively shortening the revocation period. So that the BM would only have so many days after the birth to decide to revoke instead of the original time frame since it  would have started earlier. When I heard this alarm bells kinda went off in my head. I was almost positive that this isn't a legal practice. I did a brief search on my state's, tn, adoption manual. It clearly stated that the surrender could not be signed til 3-4 days AFTER the birth and then 10 day revocation period started after that. But maybe I'm wrong, or the info is outdated or something else. Have you ladies ever heard of this practice? If you were in my place would you bring up the info I found to our friends? I'm concerned that they're going to get scammed/swindled/hurt if this agency isn't on the up and up.

Genetic testing for me = MTHFR+, also carrier for blood clotting disorder Otherwise all else normal
Dh's karotype= Normal!!

  • That doesn't sound right.  I know that there are a few states where a emom can sign consent before birth, but she does have to reaffirm after birth. EDad's can often sign consents before birth.

  • As with anything in adoption, this can vary by state, and even by birthparent. I have heard of birthfathers signing prior to birth, and birthmothers after. Perhaps they misheard something? I'd encourage them to check state laws and ask the agency a LOT of questions

  • I know of one state in the south where Emom can sign her papers before hand and as soon as baby arrives APs are fully in charge... If your states website (DHS) is saying 3 days then that's the law. I would bring it to their attention as casual as I could and see how they respond... From that point I'd figure out if I wanted to educate them further or not! Good luck

  • Thanks guys, I thought that it sounded wrong. Hopefully they just misunderstood or maybe even my DH misheard. If I get an opportunity to casually bring it up without stepping on anyone's toes, I think I will.
