Birth certificate -last name

Hi i was wondering if anyone know if you have to go to court to get your baby's last name changed the baby daddy didn't even sign birth certificate. i don't even know why i did that. clearly wasn't thinking straight. but if anyone could help that would be great thank you :):)

  • I'm not sure if I'm reading this right, The BD didn;t sign and you gave baby your last name but you want baby to have BD's last name now? How old is baby? If less than a week you might be able to call the hospital before they process the birth cert. If not then you'll have to contact whichever government authority handles name changes, and there will be a charge, just like if you wanted to change your name. 

    Not sure why you'd want to do this though. Just a change of heart? Giving baby BD's name doesn't put you in a better position for child support or anything. I could name my child Hillary Clinton Obama if I wanted to, but that doesn't make either of those people related to my baby as far as the law is concerned.

  • Try the hospital if the birth certificate hasn't been submitted. If it has I would venture to guess that as the child's only legal guardian (since GD is not on the certificate) you would have no issue doing so. Your county clerk probably handles this. You have paperwork to fill out but as long as you're not doing it to commit a crime they should approve it. I would have a lawyer look over the paperwork before filing and ask if the court will object thinking your trying to deny GD his rights. Something from the GD stating he has no interest and your testimony to take full financial and physical responsibility might be enough but a lawyer would know for certain.

    Think it's the other way around. The BD didn't sign the birth certificate and she gave the baby his last name. Now she wants to change it to hers
