Holy moly. No wonder you didn't want to get the principal involved. She very clearly isn't taking M's best interest to heart in any of this. I'm SO sorry you're dealing with this situation. I can't imagine how stressful it is for you. Many, many prayers that this resolves quickly and you are able to keep him at a more emotionally-appropriate grade level.

I'm going to comment because I've (creeper alert!) followed your adoption story since the first dossier went to Peru. At one point, we were strongly considering IA, and honestly CS, I love the way you write and hearing how M is thriving with you and your husband.
So - WTF!? Bone density and dental reports? How does the school even have those? That sounds psychotic. And since when does age determine grade level as an absolute? Not to mention - I could see a year or two of error happening, but three sounds like bullsh*t. You'd know on a child.
The other thing I don't understand is, don't a lot of kids start out at a grade level at least somewhat lower until they show they can catch up (on an educational and social level) to their peers? I mean, that's happened even historically, not to mention now. If you have all these data to back up that he's not ready to be with 8th graders, why ignore that and go straight to inaccurate measurements of his age?
Married on 3.20.2004. It took 30 month, 2 failed adoptions and IVF for our first miracle. We have had 9 foster kids since he was born and started the domestic adoption process when he was 10 month old, we had 4 failed matches in that time. After our daughter was born we brought her home and spent 2 weeks fearing we might lose her because of complications that came up. But Praise God all went through and she is ours forever! Expecting again after IVF
Ooohhhh it makes me so mad when people, like this principal, try to make these kinds of decisions without thinking about what is best for the child. No thought to what you or the teachers think is in M's best interests... as an educator, it absolutely burns me up! I'm so sorry you've been going through this!!!

As a teacher this frustrates me so much for you! That is just absolutely unheard of!!!!!! Sending you tons of good thoughts as you have to,unnecessarily, fight for what is best for your son! Just sickening they would do that!

OMG. This sounds like a no-brainer. His legal age is 10. Unless you pursue a legal age change, he is 10. End of story, nothing that the school district could possibly do about it.
I hope the district enjoys paying your court costs, because there is absolutely no way they could win this...I can't believe they would let it get this far. I bet the second they hear the word "lawyer," they settle in mediation.

I can not believe how outrageous this is. This is foolish. What a clear example of poor communication within an institution. I certainly hope that the the right people hear about this and put a stop to something so dangerous and harmful. The facts seem to be be completely ignored!
