DH is sick of BM and the whole ordeal with the insurance situation. If you recall, he was completing paperwork for the CS office to remove the extra medical withholding of $179/mth that was supposed to be used to pay for BM's insurance on the kids, which she cancelled. So the kids have been on my insurance since April (when we discovered they were no longer covered and she had dropped their coverage in Nov '12). So initially, DH told her he was working on the modification and the CS office had advised him to request the $179/mth back from her. He talked to her and agreed to only ask for it back from April instead of November. She said she would start giving us back the money soon but needed it at the moment. Flash foward, that hasn't happened and she hasn't been filling oldest SS's prescriptions on my insurance. He's had medication changes which we weren't told about until we just happened to notice different pills being sent, ect. She sends them in old bottles. When I used the pill identifier one came across as Xanax .5mg. When asked about why his ADHD pill was not showing up under our insurance she claimed, it wasn't covered because of the dose and the doctor was going to be submitting an appeal. Flash forward to yesterday and DH started working around BM since she's not being cooperative.
We have found out that she's filling his medications and different pharmacies. She lied about the ADHD pill issue- after speaking with the pharmacy DH found out that it was not denied by the insurance however, they noted that she wasn't happy with the cost so they offered her a discount card so she filled it using that. DH called another pharmacy looking for the "possible" Xanax fill and found that they had filled a prescription for Clonidine .1mg last month. The pills look similar but we are confident we keyed in the right numbers on the pill when we looked it up 2 weeks ago and the number appears to be the only difference appearance in the pills. So DH called the pedi's office and asked for a nurse to call him back with a list of all of his current medications so we could confirm which it is. He has to go in and pay to get a copy of the records though (so that's next.)
With the insurance issue, the problem with her using the card verus filing it on our insurance is that it doesn't count towards our deductible. And technically right now she has more than enough extra "medical" payments from us for the insurance she cancelled to cover the cost of all his medication and we are only supposed to pay half of medical expenses so there is no reason she shouldn't be filing it on the insurance and splitting it with us. If she followed the proper procedure of giving us copies of the bill, she would only be paying $49 versus the $60 she is paying by using the discount card since we would pay half. When she doesn't file on the insurance she is responsible for the whole bill, but then we all are responsible for it in the end if the deductible isn't met and one of the kids has an emergency, ect....
So DH is setting up an appointment to consult an attorney (something he hasn't done since their divorce) to at least possibly send a letter that we will file contempt about her dropping insurance coverage and give her the option of agreeing to sign the modification of the extra "medical" support and modify the papers that we provide coverage and remind her that she needs use the insurance and submit bills to us in the manner described in the paperwork (within 30 days of reciept). I need actual bills in order to cut her or the provider a check because I have an HSA account.
This could start a lot of other problems with her. DH has not been this pissed over a situation with her in a while. Of course, a lot of this situation was perpetuated by his being lax towards his own parental responsibilty when the kids aren't with us.

Maybe I'm biased after my situation, but ADHD drugs are a highly addictive drug teens and young adults are abusing these days. She isn't playing the system to get them and sell them to dealers is she?
@littlejen22 I don't necessarily think she doesn't have script for it. We just know that when I looked it up the pills she gave us the last weekend we had them that it came up as Xanax .5mg. We knew she had not filled it at pharmacy#1 because it wasn't in their records, so DH called pharmacy#2 to see what they had on file and they told him about the Clonidine. It could be that the pill we thought was Xanax was actually Clonidine. She never even told us the meds changed we just knew his "night" medication was a different pill than it was before. We just need to know for sure what his current medications are. We plan on rechecking the pills tomorrow when he comes over to see if we just messed up. He was on another medication at one point for "appetite" so we also wanted to know if he's still taking that as well because she has never sent that one to our house, we just know about it from the last time we pulled medical records. That way we know if we need to keep calling pharmacies because I am trying to get these claims filed on my insurance. We had checked with pharmacy#3 that she has filled out in the past and there aren't any new scripts through them. You might recall that we did report her to the police about 2-3 years ago for filling a "refill" for hydrocodone for him nearly 6 MONTHS after his first kidney stone removal because it hit DH's insurance (back before he lost that job) and so DH called the prescribing doctor (the nephrologist) and he faxed us a copy of the original script that had no refills on it and stated that he did not authorize any refills nor had he seen SS for any recent pain and then we got a copy of her signature of pick up from a pharmacy showing she did in fact get a refill. However, nothing ever came of that because her DH was volunteering at the fire station at that time in the small town they lived in that is connected to the police station and they hung out up there all the time. We mainly reported it for record purposes though and luckily they no longer live there. However, she has been shady in the past with prescriptions. We never found out why she filled that or even how. The pharmacy wouldn't admit to an error but we had a copy of the original script from the doctor showing no refills and it had been filled prior (when he actually needed it).
The other thing that is bothersome, which is why DH is pulling records is because his pediatrician is who prescribes these medications. DH is getting ready to take SS to a psychiatrist for a second opinion on his medications as he's never been seen by a mental health professional.
That's what I thought too Littlejen. This behavior is odd and indicative of drug abuse or mis-use/distribution. Not trying to say it has to be that - maybe she really is just scrambled in the head about her son's scrips, but in this day and age...it doesn't look good.
