XP: CA SDI ?

I'm due with #2 shortly and will be on short-term disability with the state for my maternity leave.  I did the same with my first but I have a question.  I somehow missed out on a week of paid leave with DD.  I think it is because the date of disability was the date I gave birth and you get paid for six weeks after date of delivery BUT there is a one-week waiting period.  So, I actually only got 5 weeks paid leave.  Is there anyway around this?  I wonder if my doc would sign that the disability started one week before I give birth, then I would be entitled to the entire six weeks after birth?  I'm not sure if my doc would do that but it is legit as I have a really long commute.

Not trying to scam the system at all; just seems odd that it says you get paid for six weeks but then there is a week waiting period (so really it's 5 weeks) if you use delivery date as disability date.

I am not super concerned about taking that week before I deliver off unpaid because I think my employer would give me a check for my vacation later if we needed it.  Just more trying to maximize the benefits I'm entitled to. 

That is of course if they aren't issuing IOUs for this too.

Any insight would be greatly appreciated!

  • That's how it worked for me too (6 weeks, but the first week is unpaid). My company did it so I just used up my sick days during the waiting period so that I still got paid.  I wish there was no waiting period :(

    Same here.  You are also entitled to the 6 weeks of Paid Family Leave, though which I believe is actually 6 weeks paid.

  • ok so you can take 4 weeks prior to delivery (given your ob/gyn lets you..which they are pretty easy to issue you the papers if you say you want to be off 1 month prior) now out of those 4 weeks 3 are paid, because of the 7 day waiting period.

    Then once you deliver you get 6 weeks or 8 if you delivered CS...no more waiting period because you already waited in the beginning...

    ...and then 6 MORE weeks should you want to take advantage of CFRA(or baby bonding) no waiting period there either since you waited in the beginning...

    now let's say it's too late, you didn't take advantage of the 4 weeks (technically 3 paid) prior to delivery...Yes now you have to wait the 7 day waiting period..so in that case you would only get paid 5 weeks...or 7 if you delivered via CS

    make sense?
