Infertility

Workplace accommodations?

Is infertility considered a disability? I'm expecting to start IVF in October and I'm wondering if I need to request an accommodation at work. I understand that there are are other tests that I will need to be doing in September.  This is going to cost me tens of thousands of dollars and I to minimize other worries as much as possible. How much time to the treatments take? Has anyone else requested accommodations at work?

Re: Workplace accommodations?

  • I do not think it is considered a disability.  Ultimately it is still something you are electing to do.

Usually offices open early enough to get done before work or, at the very least, you shouldn't have to be that late.  But that depends what time you start work and how far your office is as well.

I inquired at work and they were unsure if it would be a "disability" but said I should submit for FMLA.
  • It’s not a disability but my work did fmla for me as well in case I needed extra time off for appointments etc.
TTC 4 years. 7 failed IUI's with either Clomid, Femara and/or Trigger Shots. Started IVF journey in February 2017. Polyps removed in May. 1st IVF Transfer September 26th. BFP. Expected due date 6/14/18. Baby boy born 5/25/18 at 6 lb 9 oz. My bundle of joy.
  • It wouldn't qualify you for disability unless your doctor felt you could not work for some reason and determined you were disabled - in this case a claim would need to be submitted through the state and your doctor would put the amount of time you are considered disabled.

You may qualify for FMLA - you can ask you doctor to fill out the health certification and then you would qualify for intermittent leave with your employer.
