Will for a single mommy-to-be.

I just realized with horror that I could possibly die in childbirth. Obviously it is not likely, but if I am already thinking about life insurance to provide for my little girl, shouldn't I be thinking about future guardians? Dad will be signing off on parental rights, I don't want my family to have her, and I dont currently have a will. Can I have a will that directs guardianship of an unborn child???

  • I think this is a question best asked to an actual attorney, as they would be far more familiar with these things and could give you a better answer. But I would assume you could have a directive in place that your child would go to whomever you wish (with their prior knowledge of said document).

  • Absolutely you can direct who will care for your child. Talk with a lawyer that specializes in Wills and estates. If you can't afford one, look at legal aid. Good luck to you!
  •  Talk to an attorney licensed in to your state. A probate attorney, but preferably someone with some juvenile law experience as well. You will want help making sure the relinquishment is properly executed. I’ve practiced in juvenile law for several years, and I have seen many people think they have “signed away parental rights” without actually doing so legally.

  • Definitely talk to an attorney but I don’t see why not - ours names our 3 children and ‘any other children born or adopted into the family’

  • Hy husband and I created our will when we got married. We absolutely were able to choose guardians for our "theoretical" children at the time. They don't need to be born or even conceived to be included.
