Work! Help me please!!

So I posted a while back that my doctor was being difficult and not filling out my FMLA papers! Well today I was fired due to going over days because of my doctor! (I did switch doctors but new doc can't cover days for old doc) so anywho! Can I fight for my job back or even collect unemployment?? I even tried talking to HR for a week and no one will even talk to me about it!!

  • It depends on your state and the type of employee you are and probably other things.  HR probably won't help - they represent the company, not you.  Contact your state's unemployment office.

  • I have and they said depending on if the company agrees to it or not so i don't know what will happen! Super stressed considering my doctor was a prick and could have saved me all this stress!
  • File for unemployment, it isn't up to your company whether or not you get it, it is up to the state. Yes your company can fight it, but most times the state sides with the unemployed individual... particularly if your reason for being fired is excessive absenteeism due to a medical issue... and its not a big process for you or the company to "fight it" it all happens via conference call so you aren't going to court or anything.

  • I'm not sure if it's state specific, but I had one of those nightmare jobs with a nightmare boss, who fired me via VM, while I was on vacation, 2 days before my wedding for "not returning his call from yesterday" and umeployment told me the only valid reason to fire someone for attendance was if you are a no call no show 3x in a calander year, not 1 call out over 12 hours in advance like I was. Anyways, good luck, you should be able to at least get unemployment, if not your job back.

  • They didn't even reply to unemployment when they called to validate their reasoning for firing me so I did end up winning my case! I guess now the job search is on 13weeks pregnant hoping I'll find something!!

    This isn't the law in every state. I just terminated someone recently for excessive absences. I echo the recommendation above to consult an attorney familiar with local laws.

    OP, that sucks. I'm glad you were at least able to qualify for unemployment. If it's at all reassuring, I know from personal experience that it is possible to land a job offer while pregnant! Fx for you.

  • One of my best friends just started a new job a few weeks ago when she was 30 weeks pregnant. So it is a possibility! Good luck on your job search!

  • I think unemployment depends on the state you live in. You can potentially fight it, but would need the paper work and documentation from the previous doctor covering those days that they are firing you for. And yes... People get hired while pregnant all the time! Good luck!

    Wow! What an ass! That should be considered discrimination if you wanted to take legal action. What is wrong with some people?
