Creating a will/trust

My husband and I are getting all things financial in order and are trying to decide using one of the online websites for creating our will versus hiring a lawyer. I don't anticipate anything very complicated, just custody and financial arrangements should something happen to both of us. Any insight or experiences you have had are much appreciated!

  • We just did it. There was a lot to think about, most importantly who's designated to raise the kids if we both die suddenly. I'm a lawyer and have written simple wills before for low income clients but it made me realize how much more to it there is than I'd been doing. We hired a lawyer and I'd only want my will drafted by an attorney.

  • I've had many people recommend not using one of those websites. Hiring a lawyer is worth it because there is so much that actually goes into a will, no matter how simple it is. Hubby and I will be doing the same soon, as well as getting all life insurance policies up to date.
  • I would get all your info together and go to a lawyer. I want it legal, binding and completely unbreakable when I leave if my kids are little. We picked a close family friend to take our children over family and my husbands family comes from money so it has to be iron clad or I know my kids will end up in their hands.
  • Good for you for taking care of it now!  My son is 3 and we are just working on this now, it's something we've "been meaning to do" and time just flies by.  We're going through a lawyer - I feel comfortable using turbotax for filing taxes, but with our will we need more guidance.  
  • I have had a will since my son was little and I went to an attorney to have it drafted. It cost me about $200 but was well worth it and they update it for me as needed.

    Now that I'm married, I need to have a new one drafted to encompass our new little bean and the changes in our lives since then. For the most part, it's still the same but we just need to have it updated. I'm also a little nutty about that stuff so we have our living will, power of attorney, etc on file as well.
  • I have a legal background so I was going to get the legwork/bones of our together and then turn it over to an attorney. I haven't used any of the websites but I think my mom used one year's ago for my grandma and then took it to an attorney.

    I would recommend you go with an attorney from the start. Make a list of everything you can possibly think of and collect everything in advance. It'll help a ton!

  • What kind of paperwork is needed to set up a will/trust?  We will be having ours done soon and I want to be well prepared.
  • My husband thinks I'm insane for getting our wills prepared before the baby is here, but that's too bad for him. My father passed when we were small; we would've been SCREWED if something happened to my mother as well. I will sleep much better knowing that my LO will be raised by the people I choose, not some random judge.
  • One tip: my BIL is an attorney who specializes in wills and trusts. His policy is that the first appointment is free, so most people can get their basic documents set up with no charge. Billing comes only when you want/need changes made. Might be worth calling around. I have no idea if this is standard, but he says it works well for his business :)
