Just found out today that I am only allowed 6 weeks of maternity leave since I haven't been with the company a full year...

  • I had talked to my supervisor about it months ago and she was fine with 10 weeks. I knew 4 weeks would be unpaid. All my fmla and short term papers could be filed until last week and with an outside agency. Then today someone from hr called me asking why I hadn't talked to them....ugh because my supervisor said she talked to them and received the papers from the agency. Sorry had to vent!

  • You should research your state's mandated FMLA stuff and the federal FMLA.

    When I had #2 I did not qualify for either the state or the federal requirements (had only had my job for 4m), so I had to work that into my hiring package that I wanted 8w off.  Technically my employer could have fired me after I burned up my 1w vacation time. 

    Your state regs may be more lenient than the federal FMLA.

    Talk to your manager and your HR department and work something out IN WRITING now if you want more than 6w of job protection.  legally they may not be required to hold your position - but if you approach it professionally, you may get allowance to take unpaid leave for a few more weeks.

  • If you have been at your current job for 12 months you can't take 12 weeks of unpaind leave. This leave includes any paid time off you have accrued. This is federal law, not state.
