Maternity Leave - NYS

i know there are MANY posts about this but my situation seems to be unique- I'm getting different advice from different people, including my HR rep!

I am a teacher- due August 6. School begins September 3. My district is telling me that our maternity leave includes 40 days beginning after the baby is born, paid in full as long as you have the days accrued. I happen to have exactly 40 days saved up. They are saying that I will not have to use my time until school starts, but my leave ends October 7, or 40 days after the baby is born. After this, I cannot take any of my personal time consecutively because the 40 days begin right after the baby is born and not the first day of school. Fmla is unpaid and would cover me for 12 weeks if I decide to take time unpaid. (Until December 2)

What I'm wondering is- why do I have to use my personal days for my whole maternity leave? I live in NY which offers short term disability ($170 a week) for 6 weeks. Shouldn't I get this and then have the option to use my time accrued?

Sorry this is so lengthy but I am SO upset right now that I do not understand this! Anyone out there to shed some light or give your experience? Thanks!

  • You have to use all sick days before short term disability can be used. I am a teacher too and I have to use all my sick days built up then nothing. It's just the way short term works.

  • IIn Australia teachers get 6 months paid maternity leave at half your weekly wage, plus the government pays 18 weeks at national minimum wage, and they hold your job until your youngest baby starts school.. And teachers over here still complain about the poor conditions!!!
  • Short term does not kick in until you have exhausted your own PTO.    

    Wow, Australia sounds great in comparison to maternity leave here in the USA.
